UPDATE: VARIATION BY-LAW No 10

Dumped trolleys are a safety issue and an eyesore for the City of Marion community.

After consultation, Council endorsed a by-law to deal with shopping trolleys abandoned in the community. Provisions include requiring retailers to prevent trolleys from leaving their shopping precinct and making people accountable for removing trolleys from shopping precincts (Shopping Trolley Amenity by-law 2020 by-law Number 8 of 2020).

This is the first by-law to manage shopping trolleys in South Australia and is undergoing a rigorous process for it to be finalised. The by-law came into effect on 2 November 2020 but the enforcement provisions of the by-law begin on 1 February 2021, unless the by-law is disallowed by State Parliament.

Through the ongoing by-law making process, State Parliament’s Legislative Review Committee has provided additional feedback.

Council has listened to the comments from the Legislative Review Committee, along with that from the community and retailers, and is now seeking to make further amendments to the by-law.

  • So it applies to retailers who have 30 trolleys in their trolley fleet and not 25: in recognition that the number of trolleys a retailer has can slightly vary from time to time, eg through the need to order additional trolleys to replace or repair damaged trolleys.
  • to remove the provision for retailers to seek and be granted an exemption to the by-law: to give clarity to the by-law and remove any confusion and ambiguity of when a retailer may be granted an exemption. It has also been ascertained that there are no likely, foreseeable circumstances under which a retailer would apply for and be granted an exemption.
  • Change the date from 2020 to 2021, as Council will make the by-law in 2021.

To make these changes, a Variation by-law is now required. We are seeking your comments on the proposed change.
