Proposed Changes

A minor change is proposed to By-Law No. 1 - Permits and Penalties to:

• remove the word “licence” from the by-law as the by-law provides only for a “permit” system

Proposed changes to By-Law No. 2- Movable Signs include:

• “banners” as a separate class of movable sign, and

• making additional classes of signs exempt, including signs related to a referendum displayed during the course of that referendum; and, signs displayed with the permission of council

Q. Why are signs related to a referendum being exempted?

A. To be consistent with exemptions for election signs.

Proposed changes to By-Law No. 3 - Local Government Land include:

• the foreshore within council’s area is local government land
• a clause that would enable council to determine areas where motorhomes can camp overnight
• an exemption from the need to get permission to pick fruit in a community garden
• requiring council permission before undertaking certain activities in council wetlands (eg fishing, operating model boats, taking water) in order to protect the quality of water, wildlife and the local environment.
  
• making it clear that any noxious species caught must be disposed of appropriately and not returned to the water

Q. Why would permission be required to fish at a wetland?

A. To protect the quality of water, wildlife and the local environment.

Proposed changes to By-Law No. 4 - Dogs include:

• wetlands and areas within 5 metres of children’s playgrounds be declared “dog on leash areas”

• owners of puppies will not be in breach of the dog limit requirements until it is three months old

• a person in control of a dog must have a bag or other object for picking up and lawfully disposing of any faeces the dog may generate

Q. Where can I walk my dog off leash?

A. You can walk your dog in any park in the City of Marion, provided it is under effective control, that does not have a “dog free zone” sign.  The playground and BBQ areas in Hazelmere Reserve, Glengowrie have been declared dog free zones.

Notes: Dogs must be on a leash:

• on public roads, footpaths, and public places, except parks unless specified by council by-laws. In parks, the dog must be under effective control, which is by command. The dog must be close to the person who must be able to see the dog at all times
• on any park or reserve when organised sport is being played
• within 5 metres of children’s playground equipment
• in any wetland

Proposed changes to By-Law No. 5 - Roads include:

Proposed changes include:

• a clause to enable council to determine motorhome friendly zones

• a provision to require permission before placing flyers on vehicles on public roads. 

Q. Why could permission be needed to place flyers on vehicles?

A. To protect people from offensive material and reduce litter.

Proposed changes to By-Law No. 6 - Cats include:

• requiring all cats within the City of Marion to be identified through micro-chipping

• providing that the by-law only applies to cats over four months old

• to enable, by resolution, council to determine cat-free areas on local government land

Q. Why require cats to be micro-chipped?

A. To help return lost cats to their homes and identify cats that aren’t owned.

Q. Why could some areas be designated cat-free?

A. Sensitive areas such as wetlands could be designated cat-free to protect wildlife.
