Revocation and Disposal of Community Land

Council proposes to change the community land classification at Spinnaker Circuit Reserve – East, located at 72 Spinnaker Circuit, Sheidow Park so that it may be sold. Currently Spinnaker Circuit Reserve East is Community Land under the Local Government Act 1999.

The process of changing a community land classification is known as revocation.

The purpose of the engagement is to seek feedback on the Section 194 Report for consultation on the proposal to revoke the community land classification of Spinnaker Reserve East. This is a requirement of the Local Government Act 1999 in the process for the revocation of community land classification.

Your feedback will be used by Elected Members to assist in their decision making.

Why do we want to sell this land?

It has been identified that the reserve is currently underutilised by the community. If Council sells the land, the proceeds would be used to develop open space or other facilities as approved by Council for the benefit of the community. To sell this land, Council must submit a revocation proposal to the Minister for Planning and Local Government for approval.

Our intention for the land at Spinnaker Circuit Reserve – East

If the revocation is approved, Council intends to split the area in to two sections – Piece A and Piece B. It is intended that:

  • Piece A will be sold to St Martin De Porres School (3000m2) if the school wishes to do so at market value
  • Piece B will be sold on the open market, most likely for residential development (3158m2)

Previous consultation

In August 2020, Council conducted a consultation for the revocation of this land. This request was declined by the Minister, as the report did not provide enough information on Council’s intentions for the land. The Minister has allowed Council to undertake another community consultation and to resubmit the request.

Feedback closed on 29 October 2021. We are now collating these results.
